1. Introduction

These Terms apply to prestigeelements.com, Sacred Aiko, and all related products, features, content, and services. Prestige Elements is the business responsible for the Services, and Sacred Aiko is owned and/or operated by Prestige Elements. Please read these Terms together with our Privacy Policy and the other policies linked on this page.

2. Accounts & Membership

You must generally be at least 13 years old to independently create an account. Where Sacred Aiko offers features designed for children under 13, those features may only be used with appropriate parent or legal-guardian authorization and where permitted by applicable law. A parent/guardian who permits a minor to use the Services is responsible for that minor’s use. You are responsible for:

• Providing accurate account information
• Keeping your account credentials secure
• Notifying us of any unauthorized account activity
• Complying with these Terms

2a. Suspension & Termination

Prestige Elements may restrict, suspend, or terminate accounts for fraud, abuse, security threats, illegal conduct, or material violations of these Terms.

3. User Content

Prestige Elements does not automatically own content you create or submit ("User Content"), which may include Sacred Aiko journal entries, posts, messages, images, reflections, and other uploaded or created material. You retain ownership of your User Content. You grant Prestige Elements only the limited license reasonably necessary to host, process, store, transmit, display, secure, maintain, improve, and provide the Service functionality you request. We do not take an unrestricted marketing or commercial license over your private User Content, and private journal entries or other private content do not automatically become advertising or marketing material. Separate permission applies when you intentionally submit testimonials, ambassador content, promotional content, contest entries, or other public-facing submissions. We may apply reasonable content moderation and removal.

4. Billing & Payments

These Terms cover physical product purchases, service bookings, digital purchases, and any memberships/subscriptions if introduced, along with applicable taxes, shipping, discounts, rewards, and promotional offers. Payments may be processed by third-party payment processors; Prestige Elements does not directly store your complete card information when it is handled by a third-party processor. You must be authorized to use your selected payment method. We may reasonably hold, limit, refuse, or cancel transactions involving fraud, unauthorized payments, inventory errors, pricing errors, promotional abuse, or Terms violations. If we cancel an already-paid transaction and a refund is due, we will process it according to the applicable policy and law.

5. Accuracy of Information

We make reasonable efforts to maintain accurate information, but errors may occur involving prices, product descriptions, ingredients, images, inventory, promotions, shipping, services, appointment availability, or digital content. We may correct legitimate errors. If an error materially affects an already-submitted transaction, we may contact you, offer alternatives, or cancel the affected transaction (refunding as required by applicable policy and law). Physical product appearance, packaging, labels, colors, and batches may vary slightly without materially misrepresenting the product.

6. Third-Party Services

The Services may use third-party integrations, which may have their own terms, privacy policies, security practices, accounts, and authentication requirements. Any sharing or processing of personal information by Prestige Elements remains subject to our Privacy Policy and applicable law.

7. Service Availability

We strive to keep the Services available but do not guarantee uninterrupted operation or any specific uptime percentage. Reasonable interruptions may occur for maintenance, updates, security, technical problems, hosting/internet outages, third-party outages, or events outside our reasonable control.

8. Backups

We may maintain backups for operational purposes, security, disaster recovery, and business continuity. We do not guarantee that every piece of User Content is permanently recoverable. Backup handling of personal information remains subject to our Privacy Policy and applicable law.

9. Advertising, Promotions & Partnerships

The Services may contain sponsored content, affiliate links, ambassador content, collaborations, promotional offers, and third-party advertising. Independent third-party transactions are distinct from Prestige Elements transactions. Sponsored or affiliate relationships will be disclosed where required by law.

10. Links to Other Resources

External links do not automatically constitute endorsement. We are not responsible for independent third-party websites or apps, including their content, products, services, privacy practices, security, or policies. Where affiliate links are used, we may receive compensation from qualifying transactions, potentially at no additional cost to you.

11. Prohibited Uses

You may not use the Services for:

• Illegal activity, fraud, harassment, threats, abuse, or discrimination prohibited by law
• Impersonation or providing false account information
• Malware, hacking, unauthorized account access, or circumventing security
• Spam, phishing, unauthorized scraping or data harvesting, or privacy violations
• Intellectual-property infringement
• Fraudulent transactions, chargeback abuse, or review manipulation
• Unauthorized resale, or exploiting bugs/glitches
• Rewards, referral, promotional, ambassador-program, or booking-system abuse

11a. Enforcement

We may reasonably investigate, restrict, suspend, or terminate accounts, remove content, and cancel fraudulent benefits or transactions.

12. Intellectual Property

Prestige Elements’ original intellectual property — including, where applicable, the Prestige Elements name, logos, branding, product designs, product photography, graphics, written materials, educational materials, and original wellness content — is owned by or licensed to Prestige Elements. Original Sacred Aiko materials are also protected, including, where applicable, the Sacred Aiko name/branding, characters, character designs, stories, dialogue, artwork, environments, world-building, lessons, courses, educational/spiritual content, game elements, audiovisual materials, and software. We do not claim ownership over licensed third-party assets, fonts, music, software libraries, or stock materials. User Content is governed separately by the User Content provision.

13. Disclaimer of Warranties

To the fullest extent permitted by law, the digital Services are provided on an "AS IS" and "AS AVAILABLE" basis. We do not guarantee uninterrupted availability, error-free operation, immediate correction of every defect, or any particular personal, spiritual, or wellness outcome. Nothing in these Terms removes warranties or consumer protections that cannot legally be waived, and this disclaimer does not eliminate our responsibility for physical products or paid services.

14. Spiritual, Wellness & Educational Disclaimer

Prestige Elements and Sacred Aiko offer spiritual and wellness content and services, which may include tarot readings, oracle readings, chakra/energy work, reiki-type practices where offered, meditation, yoga, sound baths, spiritual baths, massage/wellness services, and Sacred Aiko educational/spiritual material. These do not guarantee specific spiritual, emotional, financial, relationship, health, or life outcomes. Educational and spiritual content is not a substitute for individualized advice from appropriately qualified medical, mental-health, legal, financial, or other licensed professionals. We do not make medical-treatment claims.

15. Psychedelic Education & Guidance Disclaimer

Where Prestige Elements offers psychedelic-related guidance or educational services, Prestige Elements does not: prescribe controlled substances; sell or supply illegal controlled substances through the Services; guarantee any psychedelic experience or outcome; or encourage violations of applicable law. Applicable content is provided for educational, spiritual, wellness, preparation/integration, or harm-reduction purposes as appropriate to the actual service, and is not emergency medical care or individualized medical treatment. The Website and app are not emergency services — if you are experiencing a medical emergency, contact local emergency services.

16. Product & Cosmetic Disclaimer

Our physical wellness, skin, hair, and body products come with ingredient information and directions for use. Because individuals differ, please review ingredients for allergies or sensitivities, patch test where appropriate, follow directions (including external-use instructions where applicable), store products properly, and keep them away from children where appropriate. Discontinue use if irritation or an unexpected reaction occurs and seek appropriate professional assistance for serious reactions. Individual results vary. Our products are not intended to diagnose, treat, cure, or prevent any disease unless legally authorized and properly substantiated, and product descriptions, labels, and website claims are kept consistent.

17. Bookings, Cancellations & No-Shows

Appointment booking, deposits/prepayment, cancellation, rescheduling, late arrivals, no-shows, and refund eligibility are governed by our separate Booking, Cancellation, and No-Show policies.

18. Returns, Refunds & Exchanges

Returns, refunds, and exchanges are governed by our separate Return & Refund Policy. Physical products, booked services, subscriptions, and digital purchases may have different eligibility requirements.

19. Limitation of Liability

To the fullest extent permitted by law, Prestige Elements’ liability is limited. For claims tied to a paid product or service, our liability may generally be limited to the amounts you actually paid for the product or service giving rise to the claim during an appropriate preceding period. We do not attempt to exclude liability that cannot legally be excluded. Some limitations may not apply in every jurisdiction.

20. Indemnification

You agree to indemnify Prestige Elements primarily for third-party claims arising from your User Content, material Terms violations, violations of law, infringement of intellectual-property/privacy/other rights, fraud, abuse, willful misconduct, or misuse of accounts, features, rewards, or ambassador systems. This does not require you to indemnify Prestige Elements for its own unlawful conduct, gross negligence, or willful misconduct where prohibited.

21. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining Terms remain in full effect.

22. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Texas, United States, subject to applicable federal law and non-waivable consumer protections. Before formal litigation, the parties will attempt in good faith to resolve disputes informally where appropriate. Your access to eligible small-claims procedures and non-waivable consumer remedies is preserved.

23. Assignment

You may not improperly sell, transfer, sublicense, or delegate rights granted specifically to your account without appropriate authorization. Prestige Elements may assign this agreement in connection with a merger, acquisition, reorganization, sale of the business or assets, change of control, or transfer to an affiliate/successor, and may use contractors or service providers without affecting legally required responsibilities.

24. Changes & Amendments

We may update these Terms and will update the Last Updated date. For material changes, we will provide reasonable notice through an appropriate method such as a website notice, a Sacred Aiko notice, an account notification, or email, and will follow applicable requirements for advance notice or affirmative consent where required. Newly created terms will not be applied retroactively to completed transactions where doing so would be unlawful or inappropriate.

25. Acceptance

Accessing or using the applicable Services, creating an account, making a purchase, or booking a Service constitutes acceptance of the applicable Terms to the extent permitted by law. If you do not agree, please discontinue use.

28. Privacy & Children’s Privacy Alignment

These Terms are intended to be consistent with our Privacy Policy. Sacred Aiko features accessible to children require dedicated children’s privacy/compliance implementation. If personal information from children under 13 will be collected, stored, processed, or shared, a Terms sentence alone does not establish parental consent or privacy compliance.
